Who we share it with

We share personal information only with trusted service providers (called "operators" in POPIA) that help us run our business, and only as far as they need it. They must keep it confidential and secure.

  • Website hosting: our South African hosting provider stores the website, form entries and server logs.
  • Analytics: Google provides Google Analytics and Google Tag Manager.
  • Scheduling: Calendly processes meeting bookings.
  • Email and communication: our email provider, and WhatsApp or LinkedIn when you choose to contact us there.
  • Professional advisers: our accountant or legal advisers when needed, under a duty of confidentiality.

We may also disclose information when the law requires it, for example to comply with a court order or a request from a regulator.

Transfers outside South Africa

Some of our service providers, including Google and Calendly, store or process information on servers outside South Africa, mainly in the United States and Europe. When this happens, we rely on providers that are bound by data protection laws, binding agreements or policies that offer protection comparable to POPIA, as section 72 of the Act requires.

How long we keep it

We keep personal information only for as long as we need it for the purpose it was collected, or as long as the law requires:

  • Enquiries that do not lead to a project: up to 24 months, so we have context if you contact us again.
  • Client records, contracts and invoices: at least five years, to meet South African tax and accounting requirements.
  • Newsletter subscriptions: until you unsubscribe.
  • Analytics data: according to the retention period set in Google Analytics.

When information is no longer needed, we delete it or make it anonymous.

How we protect it

We take reasonable technical and organisational steps to protect personal information against loss, misuse and unauthorised access. These include an encrypted (HTTPS) website, spam protection on forms, password-protected accounts with restricted access, up-to-date software and regular backups.

No system is completely secure. If a security incident puts your personal information at risk, we will notify you and the Information Regulator as POPIA requires.

Your rights

Under POPIA you have the right to:

  • ask whether we hold personal information about you, and request a copy of it
  • ask us to correct information that is inaccurate, out of date or incomplete
  • ask us to delete information we no longer have a valid reason to keep
  • object to us using your information, including for direct marketing
  • withdraw your consent at any time, where we rely on consent
  • lodge a complaint with the Information Regulator

To use any of these rights, email our Information Officer at jennifer@pinnacleprocessmarketing.com. We may ask you to confirm your identity before we act on a request, and we will respond within a reasonable time.

Our website and services are intended for businesses and are not directed at children under 18. We do not knowingly collect personal information from children. If you believe a child has sent us personal information, contact us and we will delete it.
